Prosecutions
Our team have experience of acting on behalf of employers and manufacturers in the full range of prosecutions by the Health & Safety Executive, ranging from the most minor accident to multiple fatalities. We have experience of advising on corporate manslaughter, outbreaks of Legionnaires’ disease and of dealing with cases where fines run into many hundreds of pounds.
We understand that directors are understandably apprehensive about HSE prosecutions. We guide them through the process, attending PACE interviews, where appropriate with the client, “lobbying” the HSE and then representing the client where prosecutions do proceed.
Instructions are received from companies direct and from their insurers, often in advance of receiving a claim from the injured person(s) or their estate.
Recent cases include:
- the nearly drowned digger operator
- Legionnaire’s disease at a hotel
- run-over by the fork lift truck
- fell from a height
- crushed by overhead crane
- arm caught in machinery
Team members:
Derek Adamson, Caroline Coates, and Rob Edwards.
