LANDMARK VICTORY FOR BULLER
JEFFRIES ON BEHALF OF ZURICH
IN POLICY TRIGGER LITIGATION
Within the last few minutes judgment has been handed down in the EL Policy Trigger Litigation following a 9 week trial which commenced on the 3 June 2008 at the Royal Courts of Justice before Mr Justice Burton. The case concerned the application of EL policies to mesothelioma claims.
Buller Jeffries acted on behalf of the Zurich Insurance Company, 1st Defendants in the 6th lead case, brought by Municipal Mutual Insurance Ltd. Zurich and 10 Local Authority Defendants, have secured a first instance win in this ground breaking litigation.
This landmark decision will be welcomed by employees, employers and insurers alike. Subject to any appeal, there is now clear guidance when pursuing EL mesothelioma claims taking away any ambiguity which was thought to exist.
We are pleased therefore to announce that the Buller’s Briefing due to take place on 28 November will be dedicated entirely to discussion of Mr Justice Burton’s judgment in the EL Policy Trigger Litigation. Derek Adamson, the Buller Jeffries partner who led the Buller Jeffries team acting for Zurich, will be joined by barristers from 4 New Square, London who appeared for the Zurich team at the trial to discuss the judgment and its effect on future mesothelioma claims.
